A GWERU man is suing a Kariba man of $20000 for allegedly engaging in an adulterous relationship with his wife of 12 years.
Brian Nheweyembwa has through his lawyers Tavenhave and Machingauta Legal Practionaers, filed summons at the Bulawayo High Court citing Jonathan Lawrence Mapfunde as the defendant.
Nheweyembwa said as a result of the adulterous affair, his marriage to Masline Nheweyembwa nee Munjanja has irretrievably broken down and he has applied for a decree of divorce. Brian and Masline got married on March 11, 2007, in terms of Chapter 5:11 of the Marriage Act. The couple has been blessed with two children.
“I have been married to Masline Nheweyembwa nee Munjanja in terms of Chapter 5:11 of the Marriages Act since March 11, 2007, and the marriage still subsists.” Said Brian.
Brian said he discovered the illicit affair last year December. He accuses Mapfunde of deliberately engaging in an adulterous relationship with his wife. Brian said as a result of Mapfunde’s action, he has suffered damages in the form of loss of conjugal rights from his wife, love and affection, emotional stress and embarrassment.
Brian seeks an order that compels Mapfunde to pay him $20000 calculated with interest from the date of summons to the date of full and final payment. He also wants his rival to pay the legal costs.
Mapfunde has not yet entered a notice of appearance to defend the summons.
